These Terms of Service ("Terms") govern your access to and use of Engayge's websites, mobile applications, and related services (collectively, the "Services"). Engayge is owned and operated solely by Engayge Social Network Inc., a Massachusetts nonprofit corporation and Internal Revenue Code Section 501(c)(3) tax-exempt organization ("Engayge," "we," "us," or "our").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use Engayge.
1. Eligibility

By accessing or using the Services, you represent and warrant that:

Engayge does not permit use by individuals under the age of 17.
Engayge may refuse service to anyone at any time for any lawful reason.
2. Account Registration & Security
To access certain features, you must create an account.
You agree to:

- Maintain the confidentiality of your login credentials
- Not share your account with others
- Notify Engayge promptly of unauthorized use
You are responsible for all activity that occurs under your account.
3. Community Purpose
Engayge exists to foster safer, inclusive digital spaces for LGBTQIA+ individuals and allies.
You agree to engage respectfully, honestly, and in good faith.
4. User Content
"User Content" means any content you submit, post, upload, or share through the Services.
You retain ownership of your User Content.
By submitting User Content, you grant Engayge a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, modify, and use your content solely for operating, improving, promoting, and maintaining the Services.
You are solely responsible for your User Content.
5. Prohibited Content & Conduct
You may not post, share, or engage in:
- Hate speech or discriminatory conduct
- Harassment, bullying, threats, or intimidation
- Content promoting violence or self-harm
- Sexually explicit content involving minors
- Non-consensual sexual content
- Pornographic content intended for sexual arousal
- Impersonation or misrepresentation
- Fraud, scams, or deceptive practices
- Doxxing or invasion of privacy
- Malware, harmful code, or exploits
- Spam, scraping, or automated activity
- Content that violates any law
Engayge may remove content or restrict accounts at its sole discretion.
6. Platform Safety
Engayge provides safety-oriented features including:
- Content moderation
- Reporting and blocking tools
- Enforcement of Community Guidelines
- Platform-level restrictions
Engayge does not guarantee that all content will be appropriate for all users.
Users are responsible for managing their own interactions and boundaries.
7. Reporting & Enforcement
Users may report violations of these Terms or Community Guidelines.
Engayge may:
- Remove content
- Issue warnings
- Suspend or terminate accounts
- Refer matters to law enforcement when legally required
Engayge has no obligation to monitor all content but may do so.
8. Business Listings & Reviews
Engayge may display business listings, profiles, ratings, and reviews.
Engayge does not guarantee the accuracy of third-party information.
Engayge is not responsible for interactions, services, or transactions between users and third parties.
9. Intellectual Property
Engayge owns or licenses all platform software, branding, logos, trademarks, and design elements.
You may not copy, modify, distribute, sell, or exploit Engayge materials without written permission.
10. Third-Party Services
The Services may link to third-party websites or services.
Engayge is not responsible for third-party content, policies, or practices.
Use third-party services at your own risk.
11. Privacy
Your use of Engayge is subject to our Privacy Policy.
12. Termination
You may stop using Engayge at any time.
Engayge may suspend or terminate your account at any time, with or without notice.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
ENGAYGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
ENGAYGE DOES NOT GUARANTEE UNINTERRUPTED, SECURE, OR ERROR-FREE SERVICE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
ENGAYGE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.
ENGAYGE'S TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID ENGAYGE IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.
15. Indemnification
You agree to indemnify and hold harmless Engayge from claims arising out of:
- Your User Content
- Your use of the Services
- Your violation of these Terms
- Your violation of any law or third-party right
16. Dispute Resolution & Arbitration
Any dispute arising from these Terms or the Services shall be resolved through binding arbitration, except where prohibited by law.
You waive the right to participate in class actions.
17. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
18. Changes to Terms
Engayge may update these Terms at any time.
Continued use of the Services after changes constitutes acceptance.
